This Disclaimer forms part of the Agreement for the Property Passport Service.
1. Internal tool only
The Service is a property-management tool with no public listing surface. Anyone may register an account, but access to any property record is by invitation only. It has no public advertising or public property-search surface. Access by an owner, agent, tenant, or admin is a Service permission only and does not prove identity, ownership, agency appointment, professional registration, or legal authority.
2. No professional advice or transaction service
The Operator provides technology only. It is not acting as an estate agent, valuer, property manager, negotiator, financier, lawyer, tax adviser, or investment adviser, and is not a party to any property transaction or tenancy. Users should verify facts against signed documents and obtain independent professional advice where appropriate.
3. User-supplied records
Property, membership, tenancy, rent, media, floor-plan, title, tax, and contact information comes from users and may be incomplete, inaccurate, out of date, or different from the real-world agreement. Service records do not create or change ownership, tenancy rights, payment obligations, or professional authority.
Each member may hold their own copy or view of a property record. Removing access or a dashboard copy is not deletion of records retained by another member or by the Service for traceability.
4. Relying on Service information is your own decision
Because the information described in clause 3 comes from users and the Operator does not verify it, any decision you take in reliance on it — including a decision to buy, sell, rent, let, price, lend against, or enter into or end a tenancy — is taken at your own risk. Before you rely on anything in the Service, check it against the signed documents, the issued title, and the relevant registry or authority, and obtain independent professional advice where the decision matters to you.
This clause allocates the risk of relying on unverified user content. It does not exclude the Operator's own liability, which is dealt with in clause 15 of the Terms of Service and remains subject to Malaysian law.
5. Private documents and identity data
Access controls reduce but cannot eliminate the risk of unauthorised access. Title and tax documents are intended for the property owner, an agent granted editing rights, and admins, and may also be disclosed through a share link when the owner ticks Include private documents; media and floor plans are available to joined members. Users must still avoid uploading unnecessary personal data and must protect anything they download.
IC and company numbers are stored as hashes for exact-match checks and are not displayed. Hashing lowers exposure but is not a guarantee of anonymity or immunity from attack.
6. Notifications are reminders only
Membership, invitation, closure, rent-payment, and tenancy-renewal notifications are operational aids. Daily jobs, email providers, devices, connectivity, configuration, or user opt-outs may delay or prevent delivery. A reminder is not a demand, receipt, legal notice, accounting record, or substitute for a user's own diary and contractual obligations.
7. Account closure and retention
Account closure does not erase property records, audit logs, or records another participant relies on. The email may be reused immediately, but memberships do not transfer to the new account. The closed profile, and the property records that account held, are removed after three months, while a closure audit entry and its name/email snapshot remain for traceability.
8. Planned features are not promises
Banking-gateway rent-receipt tracking, Telegram contact verification, and multiple tenancies per property are planned only. They are not active, guaranteed, or available for reliance. If launched, automated or third-party results may still be incomplete or wrong and must be checked.
9. Availability and lawful limits
The Service is provided "as is" and "as available". We do not guarantee uninterrupted operation, error-free data, reminder delivery, or suitability for a particular purpose. Nothing in this Disclaimer excludes a mandatory Malaysian consumer right or liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence.
Voluntary use, your data, and the Operator's rights
Use of the Service is entirely voluntary. Nobody is required to use it, and you choose whether to create an account and what to store in it. The Service is a convenience for organising your own property information. It is not a system of record, an archive, or a backup service, and you remain responsible for keeping your own copies of anything you cannot afford to lose.
To the extent Malaysian law allows, the Operator accepts no responsibility for any loss, corruption, deletion, or inaccessibility of data or content, however caused, including but not limited to suspension or termination of an account, discontinuation of the Service, infrastructure or provider failure, cyber-attack, or your own act or omission.
The Operator may suspend, restrict, or terminate any account and remove any content at any time and with immediate effect, on the grounds set out in the Terms of Service, including but not limited to spam, fictitious records, storage abuse, content that is not property information, and conduct the Operator considers fraudulent, deceptive, or otherwise suspicious. That judgement is the Operator's alone and no evidence or reasoning need be disclosed.
The Operator may sell, assign, transfer, licence, rent, lease, franchise, or otherwise dispose of the Service and the business, in whole or in part. From the transfer date the successor takes over the Operator's rights and duties and becomes the data user responsible for personal data held in the Service.
